Dozens of lawsuits against drug companies are again moving forward after the decision by the Supreme Court in March that FDA approval does not preempt drug lawsuits filed under state law, as the manufacturer bears the ultimate responsibility for the content of its label at all times. According to Bloomberg news, the decision in the case of Wyeth v. Levine has opened the floodgates for potentially thousands of cases against the makers of Plavix alone.

"Every failure-to-warn case against a drug company has been affected by Wyeth," Michael Miller, a plaintiffs' attorney in Alexandria, Virginia, told the news source.

Aboutlawsuits.com reports that 27 Plavix lawsuits that had been on hold for a year are already moving forward again.

In addition, Bloomberg reports that cases against drugs from numerous other companies have been restarted and even some cases that were dismissed are being refilled.
